Terms and Conditions
Last updated: 21 October 2026
These terms are an agreement between you and East Africa Data Handlers Ltd (“Gubato”, “we”, “us”) and apply when you use the Gubato mobile app, website and related services (the “Services”). By creating an account or using the Services, you agree to them. If you do not agree, please do not use the Services.
1. Your account
- You must be at least 18 years old and able to enter into a binding contract.
- You sign in with your phone number and a one-time code. Keep your phone and codes secure; you are responsible for activity on your account.
- Give accurate information and keep it up to date.
- We may ask you to verify your identity before you can use some features, such as wallet withdrawals or selling on Gubato.
2. Group orders
- Gubato lets members pool their orders in groups to buy at better prices. Group prices, minimum quantities and order deadlines are shown before you commit.
- If a group order does not reach its minimum by the deadline, it may be cancelled or extended. If it is cancelled, the amount you paid is returned to your Gubato wallet.
- Group admins can manage members and orders in their group. Be respectful of other members and only add people who have agreed to join.
3. Prices and payment
- Prices are in Kenya Shillings (KES) and include applicable taxes unless stated.
- Delivery fees, if any, are shown before you pay. Prices may change, but changes do not affect orders you have already paid for.
- You can pay with M-Pesa or your Gubato wallet balance. Payments made through M-Pesa are also subject to Safaricom’s terms.
- If an item is unavailable or a price is shown in error, we may cancel the affected order or item and refund what you paid.
4. Gubato wallet
- Your wallet holds funds you top up, refunds and rewards, for use on Gubato. It is not a bank account and does not earn interest.
- Withdrawals may require identity verification and are subject to the limits and fees shown in the app.
- Promotional credit and rewards cannot be withdrawn as cash and may expire as stated when they are given.
- We may hold or reverse transactions we reasonably suspect are fraudulent or made in error.
5. Delivery and pickup
- We deliver to your chosen location or a pickup point. Delivery times are estimates and may be affected by events outside our control.
- You may need to give a verification code when you receive your order. Check your items when you receive them and tell us about any problem as soon as possible.
- Risk in the goods passes to you once they are delivered or collected.
6. Returns and refunds
If an item arrives damaged, defective, expired or is not what you ordered, contact us promptly with details and photos. Where your claim is confirmed, we will replace the item or refund you, usually to your Gubato wallet. Perishable goods must be reported on the day of delivery. Your rights under the Consumer Protection Act, 2012 are not affected.
7. Suppliers, creators and livestreams
- Products are supplied by independent suppliers. We work to list accurate information, but product details, images and availability come from suppliers.
- Creators may promote products in livestreams and storefronts. Their opinions are their own and are not statements by Gubato.
- Suppliers and creators who use Gubato also agree to separate partner terms.
8. Acceptable use
When using the Services, you must not:
- break any law or use the Services for fraud, money laundering or other crime;
- post content that is abusive, hateful, sexually explicit, misleading or infringing;
- harass, spam or impersonate other people;
- create fake accounts or abuse referrals, rewards or promotions;
- interfere with, scrape, reverse engineer or try to gain unauthorised access to the Services.
9. Your content
You keep ownership of messages, photos, videos and reviews you share. You give us a non-exclusive, royalty-free licence to host, display and use that content to run and promote the Services. You are responsible for what you share, and we may remove content that breaks these terms.
10. Our intellectual property
The Gubato name, logo, app, website and their content belong to us or our licensors. You may use the Services for personal, non-commercial purposes only, and may not copy or reuse them without our written permission.
11. Suspension and closing your account
You can close your account at any time. See how to delete your account. We may suspend or close accounts that break these terms, put other users at risk or are involved in fraud. Any wallet balance that is not subject to an investigation or legal hold will be made available for withdrawal.
12. Disclaimers and liability
We provide the Services with reasonable care and skill, but we cannot promise they will always be available or free of errors. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot be limited by law.
13. Privacy
Our Privacy Policy explains how we handle your personal information.
14. Changes to these terms
We may update these terms. We will post the new version here and, for significant changes, let you know in the app or by message before they take effect. If you keep using the Services after that, you accept the updated terms.
15. Governing law and disputes
These terms are governed by the laws of Kenya. If you have a complaint, contact us first and we will try to resolve it. Any dispute that cannot be resolved will be handled by the courts of Kenya.
